By using the MacroSpys.com website and the MacroSpys service, you expressly agree to be bound by and abide by the following Terms of Use.

4. When providing your payment information for the purchase of the Software, you must be aware that it is not MacroSpys that collects this information, rather it will be the Payment Provider that receives the payment details;
5. You are aware that MacroSpys is not responsible for any third party data leaks on DSN databases and / or servers.
6. You will not use the Site or the Service in violation of any law to which you are subject. However, MacroSpys is not responsible for the subsequent use of the Software.
7. You agree to read the Compatibility Policy and verify the requirements of your target device in accordance with the Compatibility Policy before placing your order on MacroSpys.com.
8. You agree that MacroSpys assumes no responsibility for the installation of the Software on a target device.
9. You will apply all instructions and documentation provided by MacroSpys on MacroSpys.com.
10. You are responsible for restricting access to your account and / or use of the Software to third parties. Therefore, in the event that access to your account has been deliberately or negligently granted to a third party, you acknowledge that MacroSpys does not assume responsibility.
11. You will install the Software on devices you own or on any other device only with the consent of its owner.
12. We reserve the right to modify, cancel or reject the MacroSpys Service to anyone for any reason and without prior notice at any time.
13. We reserve the right to modify these Terms at any time.
Software application
1. The Software may only be used in connection with the End User License Agreement and with the rules, restrictions or documentation set forth by MacroSpys from time to time.
2. You understand that MacroSpys, in its sole discretion, may at any time and for any reason, suspend or cancel any license and disable the functionality of the Software. In such case, the information you have already accessed will not be available without prior notice.
3. MacroSpys reserves the right to add or remove features or functions of the Software at any time and in its sole discretion.
4. It is possible to use the basic features package on a device without jailbreak (iOS) or rooting (Android). If you want to have access to premium features in any other package, you may need to jailbreak (iOS) or root (Android) the device, which is the legal procedure according to applicable law.
5. If your device, as a result of the operating system update, was unlinked / disconnected from the Software, we recommend that you contact customer service to link it again. You should consider that, in this way, you may lose the warranty of the target device's operating system and, by linking it again, you do so at your own risk.

Acceptance
1. By using our Site and / or the Service, you confirm that you have read and accept these Terms of Use, as well as the End User License Agreement, the Privacy Policy, the Refund Policy, the Cookies and the Compatibility Policy.
2. MacroSpys can revise the Terms of Use, End User License Agreement, Privacy Policy, Refund Policy, Cookie Policy and Compatibility Policy at any time and without prior notice, and new versions will be available on the Site.
3. By not agreeing with any part of these Terms of Use, End User License Agreement, Privacy Policy, Refund Policy, Cookies Policy and Compatibility Policy, you must stop using the Site and / or the Service immediately.
Security
1. MacroSpys takes care of the integrity and security of your personal information.
2. You acknowledge that, by ordering the Product, you are voluntarily providing your personal information to MacroSpys and the Payment Provider.
3. You understand that we may use your personal information to contact you with newsletter, marketing or promotional materials and other information related to the Product. The user always has the option to unsubscribe.
4. MacroSpys archives your personal information in its fully encrypted database. It means that MacroSpys does not have direct access to your personal data. However, MacroSpys is not responsible for any third party data leaks in the databases.
5. In case of disclosure of such encrypted data, MacroSpys cannot be held responsible.
6. You agree to be obliged to retain the private encryption key provided by MacroSpys.
7. MacroSpys cannot collect or store in its database the records and data exported with the use of the Software from a target device in the event that (i) the data is more than 3 (three) months old; (ii) your account has expired.
8. Upon expiration of your account, all records and data exported with the use of the Software from a target device will be deleted within 1 (one) month.
9. You acknowledge that MacroSpys does not encourage its users to illegally use the MacroSpys service.
User Requirements
1. By ordering the Product, you acknowledge that you are over 18 years of age.
2. By installing the Software on a target device, You acknowledge and agree that You
  (i) are the parent of your minor child;
  (ii) is an employer, owner of the devices operated by its employees;
  (iii) own this device or You notified the owner of the device and received their consent.
Target device compatibility
1. You know that it is necessary to check the compatibility requirements of your target device, before using the Software.
2. If your device does not comply with the Compatibility Policy, You will not be able to use the Software.
3. In case of not having complied with the Compatibility Policy before purchase, you acknowledge that it is your responsibility and you will not be reimbursed.
4. In case you have not complied with the Compatibility Policy before use, you agree that it is your responsibility and you will not be refunded.
5. You understand that if your device is supported according to the Compatibility Policy, you will need to jailbreak or root your device (if necessary) to use the Software.
Software updates
1. In order to improve the Service, MacroSpys may update the Software from time to time.
2. You acknowledge and agree that MacroSpys may update the Software with or without notice to you.
3. You acknowledge and agree that MacroSpys may request you by email or through the Control Panel to update the Software on your target device.
Refund and return
1. Please review the Refund Policy. The MacroSpys Software includes a money-back guarantee if, for any reason, you are not satisfied.
2. Your eligibility for a refund may depend on the Product package, the time elapsed since the transaction, etc.
Links
1. The Site may contain links to websites operated by other parties.
2. MacroSpys provides such links to other websites as a convenience, and it is up to the user to use them or not.
3. The linked sites are not controlled by MacroSpys, and MacroSpys is not responsible for the content available on them.
Compensation
1. You agree to hold, defend and hold MacroSpys and related parties harmless, from any liability, claim, lawsuit, damage or other loss, including reasonable attorney's fees, resulting from or arising out of your use of the Site, the Software and / or the Service or any breach by you of these Terms or any other policy that MacroSpys may issue for the Site, the Software and / or the Service from time to time.
Assignment

No waiver
1. Failure or delay by MacroSpys to ensure compliance with these Terms does not constitute a waiver of those Terms.
2. MacroSpys's explicit waiver of any provision, condition, or requirement of these Terms will not constitute a waiver of any future obligation to comply with such provision, condition, or requirement.
Entire agreement
1. These Terms, including documents explicitly incorporated by reference, constitute the entire agreement between You and MacroSpys with respect to the Site and / or Service and supersede all prior or contemporaneous communications, whether electronic, oral or written, between You and MacroSpys with respect to to the Site, Software and / or Service.
Termination of service
1. The Service may be terminated when the subscription expires.
2. MacroSpys reserves the right to deny service to any user at its sole and absolute discretion.
3. The Service is offered with the understanding that MacroSpys may cancel any subscription and / or access to the Service at any time, for any appropriate reason, including, but not limited to, any violation of these Terms.
4. At any time MacroSpys may stop offering and / or supporting the Service.
5. MacroSpys reserves the right to deny the service or, if applicable, terminate the service of any user, including, but not limited to, a user who attempts to monitor the device of a person who has not given their consent. In this case, MacroSpys reserves the right to block all accounts associated with said possible offending user.
LEGAL EFFECT
1. These Terms describe certain legal rights. You may have other rights under the laws of your State or country. These Terms do not change your rights under the laws of your State or country.
2. In the event that the laws of your State or country do not allow you to use the Software in full or with respect to some of its characteristics, you acknowledge and accept that it is your own responsibility.
